Terms of Service

1. Acceptance of these terms
These Terms of Service ("Terms") govern access to and use of StartMyMarketplace (the "Marketplace", "we", "us" or "our"), including the storefront, customer dashboard, checkout, wallet, membership plans, custom orders and support system (together, the "Services"). By creating an account, completing a checkout as a guest, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
StartMyMarketplace is operated by StartMyMarketplace, Pune, India ("Company"). Product catalogue content (descriptions, screenshots, changelogs) is authored per listing and forms part of the offer for that product, not of these Terms.
2. Your account
Some parts of the Services require an account. You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for all activity that happens under your account. Tell us immediately if you suspect unauthorised access.
Checking out as a guest still creates an account for you, using the email address you pay with, so your licence keys, invoices and order history stay reachable from one place afterwards.
3. Products & licensing
Unless a product's own listing states otherwise, a licence purchased on StartMyMarketplace is per domain, with unlimited re-activations on that domain. A licence is not transferable to a different product and does not grant ownership of the underlying source code beyond what its listing describes.
You may not resell, sublicense, redistribute or share a purchased product or its licence key outside the domain it was issued for, or remove or circumvent its licence verification. We reserve the right to revoke a licence found to be used in breach of this section, and to act on piracy reports submitted through the Services.
4. Purchases, wallet & memberships
Prices are shown at checkout in the currency offered there. Payment is processed by a third-party payment gateway — see Third-party services below — and your full card or bank details are never stored on our servers.
StartMyMarketplace maintains a wallet for each account. Wallet balance can be added by topping up, is credited automatically in some cashback and refund cases, and can be spent at checkout like any other payment method. Wallet balance is not cash, carries no interest, and is not redeemable for a bank transfer or withdrawal except where these Terms or the Services say otherwise (for example, a partner's earnings — see Partner program — are a separate ledger from wallet balance). Some wallet credit carries its own expiry date — a membership plan's periodic credit, for instance, typically lapses before the next one is granted — shown wherever that credit was granted; credit with no stated expiry does not expire.
Membership plans renew automatically at the end of each billing period, either from your wallet balance or by charging the card or mandate on file, depending on which auto-renewal method you have selected in Dashboard → Membership. You can change or turn off auto-renewal, or cancel a plan outright, from that same page at any time — see our Cancellation Policy for exactly how and when that takes effect.
5. Refunds & cancellations
Because every product delivered through the Services is digital and delivered instantly on purchase, sales are final except in the limited cases described in our Refund Policy. Membership cancellations are covered by our Cancellation Policy. Both are part of these Terms by reference.
6. Support & custom orders
Support for a purchased product is provided through the support ticket system linked from your dashboard. Response times and the scope of what support covers (bug fixes and usage questions, not free custom development) may be described further on the support page itself.
A custom order is bespoke work quoted and agreed with you before any work begins. Once you accept a quote, that quote's own terms (scope, price and delivery) govern the engagement alongside these Terms; changes beyond what was quoted are treated as new, separately quoted work.
7. Partner program
Approved partners may earn commission on referred sales, tracked and paid out through the partner hub. Enrolment, commission rates, payout thresholds and eligibility are set out when you apply and may be updated by us with notice through the partner hub; continued participation after such a change constitutes acceptance of it.
8. Acceptable use
You agree not to:
- use the Services for any unlawful purpose, or in a way that infringes anyone else's rights;
- attempt to gain unauthorised access to another account, to our systems, or to a product's licence verification;
- upload malicious code, or use the Services to distribute malware;
- scrape, resell access to, or systematically republish the catalogue or its content outside of buying a product through checkout;
- abuse the support ticket, custom order or partner systems (for example, filing false piracy reports or fabricating referral traffic).
We may suspend or terminate access for a violation of this section — see Suspension & termination.
9. Intellectual property
Except for what is explicitly licensed to you on purchase, all rights in the Services — the storefront, the platform, its design and its own code — remain with the Company or its licensors. Each product's own listing states what rights a licence for that product grants; nothing in these Terms grants rights beyond that listing.
10. Third-party services
The Services rely on third parties to operate: a payment gateway to process card and other payments, and an email delivery provider to send account, order and support notifications. Your use of the Services is also subject to those providers' own terms where you interact with them directly (for example, entering card details on a gateway's hosted payment page).
11. Disclaimer of warranties
The Services and the products sold through them are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure or error-free, or that a product will meet every requirement of your particular use case beyond what its own listing describes.
12. Limitation of liability
To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Services. Our total liability for any claim arising from these Terms or the Services is limited to the amount you paid us for the product or subscription giving rise to the claim in the twelve months before the claim arose.
Nothing in these Terms limits a liability that cannot lawfully be limited or excluded in your jurisdiction.
13. Suspension & termination
You may stop using the Services at any time and, for a membership, cancel from your dashboard as described in our Cancellation Policy. We may suspend or terminate your account if you breach these Terms, including the acceptable-use rules above, or where required to prevent fraud, abuse or harm to the Services or other users. Sections that by their nature should survive termination — including licensing obligations for products already purchased, intellectual property, disclaimers and limitation of liability — continue to apply.
14. Changes to these terms
We may update these Terms from time to time, for example as new features (like the wallet or membership plans) change how the Services work. We will update the "Last updated" date above when we do; continued use of the Services after a change takes effect is acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of India, without regard to its conflict-of-law rules, and any dispute arising from them will be subject to the exclusive jurisdiction of the courts of Pune, India, except where local consumer-protection law gives you the right to bring a claim elsewhere.
